Client understands that if their Dog(s) causes property damage, or bites or injures any dog, or person (including but not limited to Trainer and Trainer’s agents), during or after the term of this Agreement, then Client agrees to pay all resulting losses and damages suffered or incurred, and to defend, indemnify, and hold harmless the Dog Service, Trainer and Trainer’s agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If Dog is injured in a fight or in any other manner during or after the term of the Agreement, Client assumes the risk and agrees that Trainer is not responsible for any resulting injuries, losses, damages, costs or expenses and client will indemnify and hold harmless Dog Service and its agents.
5. Client also understands and agrees that in admitting their dog to the Dog Service, Dog Service has relied on their representation that their dog(s) are in good health and medically capable to be in the program.
6. All dogs must be current on all vaccinations including: Distemper/Parvo, Rabies, & Bordetella (kennel cough) each year. Proof of vaccinations will be required upon admission to Dog Service. Dogs on a Holistic Care Plan must provide written documentation from your veterinarian.
7. Client agrees and explicitly states that by signing this agreement that their dog is free of fleas. If dog(s) has an infestation, Client will be financially responsible for any treatment Dog Services must perform.
8. Client recognizes and accepts that while their pet is under control with Dog Services it may be stressful to the pet and Client will not hold Dog Service responsible for induced illness, injury, behavior change, or weight gain or loss during or after their stay.
9. Dog Service reserves the right to decline acceptance of a pet if found to have medical condition or exhibits behavior that renders the opinion that our facility is not in the best interests of the pet.
10. If Dog Service finds that Client’s dog is not medically fit for services provided, Client is not entitled to a refund.
11. Client further understands and agrees that any problems that develop with Client’s dog(s) will be treated as deemed best by staff and volunteers of Dog Service in their sole discretion, and that Client assumes full financial responsibility for any and all expenses involved. Dog Services may in its sole discretion may engage the service of a veterinarian of its choosing; administer medication, which expenses thereof shall be paid by owner.
12. Dog Services will not be responsible for pre-existing medical conditions including but not limited to; heart conditions, skin allergies/inflammation, moles, surgical sites, arthritis, hip dysplasia, ear infections, fatty and non-fatty tumors etc. on any dog for any services. Client is to advise Dog Service of any medical conditions in writing.
Warranties
13. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to Dog Service or anything else.
14. No guarantees of future behavior. Client acknowledges that Dog Service has not represented, promised, guaranteed or warranted that Dog will never bite, that Dog will not be dangerous or vicious in the future, that Dog will not exhibit other behavioral problems, or that the results of the training will last for any particular amount of time.
15. The Client acknowledges that dog training will not provide exact results. Each dog is different in regards to ability, breeding, and temperament.
Miscellaneous
16. Client allows Dog Services to photograph dog(s) while in their care. These photos may be used for marketing purposes.
17. Client acknowledges that Ohio, Indiana, and Kentucky do not require certification in order to train dogs at the time of this contract. Dog Service is current on all information pertaining to certification in the territories listed above. Dog Service will comply with all requirements set forth for Dog Trainers in the State of Ohio.
18. Dog Service has the sole and exclusive right to terminate this Agreement for any reason by giving Client written notice of termination.
19. Client recognizes that any and all disputes under this agreement shall first be conducted through binding arbitration pursuant to the Ohio rules of arbitration. All arbitration proceedings shall be conducted in Hamilton County, Ohio. This shall be Client`s sole recourse in the event of a dispute.
20. Client hereby waives trial by jury in any action, proceeding or counterclaim brought on any and all matters arising out of this Agreement.
21. Client shall pay Dog Service's reasonable attorney’s fees and costs incurred in any dispute or legal proceeding arising from this Agreement now or in the future, whether under this Agreement, subsequent oral or written agreement, or otherwise.
22. If any portion of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.
23. This Agreement constitutes the entire agreement between Dog Service and Client. No promises or representations, other than those contained herein or implied by law, have been made by Dog Service or Client. Any addendum or modification to this Agreement must be in writing and signed by both parties.
